BoG Governor breathes sigh of relief

The contempt of court case brought against the Governor of the Bank of Ghana, Paul Acquah, was yesterday struck out as withdrawn.
The action of the court was prompted by Rockshell International Limited. Dr. Paul Acquah was not present in court, neither was he represented by anyone.
According to Alfred Agbesi Dzakpasu, counsel for Rockshell, the company was notified that the Governor was made aware of the court order that he should pay an amount of GH¢700,000 to it only recently.
He explained to the court that the Governor claimed that its (court's) order came to his notice on January 14. Mr. Dzakpasu was of the opinion that whoever represented the Governor on January 9 should have informed him about the court"s order.
However, to the counsel for the bank, the harm had already been done and described media reports on the matter as unfortunate.
He was of the view that if counsel for Rockshell International Limited had done thorough search, he would have found out that the Governor was not served the notice.
He consequently pleaded for a cost of 5000 Ghana cedis to be awarded against Rockshell International Limited. The court however, awarded a cost of 3000 Ghana cedis.
On January 22, 2009, a contempt of court charge was preferred against the Governor of the Bank of Ghana at an Accra Fast Track High Court for his failure to implement an order for payment of an amount of GH¢700,000 to Rockshell International Limited as instructed by an Accra High Court.
Rockshell, who sued government for its inability to pay for a job it executed on the Keta Sea Defence project, obtained judgment against the Attorney-General on November 20, 2006. The judgment cost was held by the Bank of Ghana on behalf of the Government of Ghana.
Pursuant to a Garnashee proceedings commenced by Rockshell International, the High Court ordered the Bank of Ghana to release an amount of GH¢700,000 in an account referred to as contingency operational account number 0121360058002 to the applicant’s company.
According to the General Manager of Rockshell, Alfred Hall, the order was made on January 9, 2009, but the Governor had since then refused to release the money to the company, despite several visits to his (Governor’s) office.
He pointed out that the Governor’s refusal to release the money amounted to contempt of court.
