Engineer cries foul

The World Mission Agency Inc and its Head Pastor, Dele Bamboye, have been dragged before an Accra High Court for breaching the confidence reposed in them by their benefactor, Azariah K A Baiden, Managing Director and Chairman of Adom Ara Engineering Services Ltd.
Mr Baiden on February 19, 1998, offered a parcel of land situated at Community 9, Tema, which was leased to him by the Tema Development Corporation, to the WMA to establish a Bible Institute to benefit Christians in Tema and its environs.
A letter handing over the land to the Church, reference AES/ACB/1998/01, written by Mr Azariah stated among other things that " I write to confirm our verbal discussions on Tuesday 3 and Friday 6, 1998 respectively pertaining to the above subject?..be informed that the said land LI/7/12-13 at Tema light industrial area [has on it] the following building materials that can build the administration block easily," it further went on to mention those materials as "burnt bricks, large quantities of pit sand, large quantities of half stones for the foundation, and large quantities of half stones for pillars and columns."
Some of the conditions attached to the lease from TDC stipulate that the lessee is not permitted to sublet or transfer the whole or part of the vacant; that the lessee shall contain all such other covenants that are normally included in leases of land in the Tema Light Industrial Area.
However the Church, instead of using the land for its intended purpose, allegedly sold it to one Xoese Glymin at the cost of ?6,000,000. A memo signed by the Head Pastor, Dele Bamboye to finalise the deal, stated that "a piece of land that was given to the Agency by the Managing Director and Chairman of Adom Ara Group of Companies at Community 9 has been transferred to Sister Xoese Glymin, by the Agency".
Realising that WMA were not the rightful owners, Madam Xoese Glymin consulted Adom Ara Engineering Services Limited, to assist her transfer the land.
Not pleased with the actions of the WMA, Management of Adom Ara Engineering Services Limited, made every effort to settle the situation amicably by offering to refund the money she paid for the land with interest, but to no avail hence the court action.
The issues before the court included whether Adom Ara Group of Companies divested itself of its interest in the land in contention; offered the land for purposes of erecting an administrative block on the plot for use by the WMA.
The case stands adjourned to April 19.
