Case against Korle Bu operation on wrong leg continues

Lawyers of Frank Darko, the JSS graduate whose left knee was operated on instead of the right, by three Doctors of the Korle-Bu Teaching Hospital have asked a Fast Track High court to compel the lawyers of the Doctors to provide them with the medical report of their client.
The documents include the physiotherapy card of Frank Darko issued on 18 November, 2005.
In the case brought against three Doctors ( Addo Kennedy, Korpisah and Agbeko) and the governing Board of the Korle-Bu Teaching Hospital, the plaintiff, Frank Darko, is seeking general damages of ?800 million for clinical negligence.
Yesterday's hearing was more about legal acrobatics than a substantive hearing, with counsel for the plaintiff, Thomas Hughes and Bob Senyalah, filing a motion for discovery of relevant documents, whilst those representing the defendants, Emmanuel Arhin, and Nana Yaa Faibille, filed for leave for amendment of their clients" affidavit.
The Court granted all the applications made and asked the plaintiff to send copies of the documents they will file to the defendants.
Aside from the general damages of ¢800 million, Master Darko is further asking for special damages to defray the cost of treatment, drugs and transportation estimated at ¢9.44 million.
The case was adjourned to 6 November, 2006.
