Egbert sues Pratt, Insight

Egbert Faibille, Managing Editor of the Ghanaian Observer and a legal practitioner, has sued the Managing Editor of the Insight, Kwasi Pratt Jnr, and four other associates of the paper for general damages, including aggravated and or exemplary damages, for libel in respect of a story carried by the paper against him on November 13, 2006.
He is seeking an order for retraction and apology of the said publication with the headline "Exposed (1) "Bartels blows State funds on party friends and journalists"Over ¢36 billion spent on them", with equal prominence as the said publication.
He is further seeking the court to restrain the defendants from publishing similar or other defamatory statements or stories about him, and has also asked for costs.
Joined to the suit are the Editor of the Insight, Peter Kojo Apisawu, Circulation Manager, Ato Kwamina Pratt, Production Manager Ken Klevor and the Publisher and Proprietor of the Insight, Militant Publications Limited.
In his statement of claim, Mr Faibille said on Monday November 13, 2006, in the Vol 12 No 198 edition of the Insight, on the front page and pages 3 and 7 respectively, the paper falsely and maliciously published or caused to be published an article title "Exposed (1) "Bartels blows State funds on party friends and journalists" Over ¢36 billion so far spent on them" alongside the publication of a photograph of him on page three of the publication.
Mr Faibille said the newspaper report which was attributed to Peter Kojo Apisawu made, among others, the allegation that state funds had been used to pay for his private telephone calls and broad band internet access.
He said it further stated that he, together with others have enjoyed ¢36bn of state money and that he is a praise singer, a front journalist for Government.
Describing the allegations as "utterly false," Mr Faibille said they were understood to mean that he was a compromised journalist whose analysis and commentary on national issues are not deserving of any attention or serious consideration by virtue of his being compromised by Government with the payment of his utility bills.
He is also asking the court to restrain the paper from their intentions and threats to continue the publication of similar and other defamatory material statements or stories about him.
