Court refuses bail for alleged armed robber- they are too many in the system, says judge

An Accra High Court Judge has refused bail before trial for a suspected armed robber, Rouf Imam, brought before it on Monday.
Giving the ruling, His Lordship, Isaac Lartey Young, said although Article 14 subsection 4 of the 1992 Constitution gives the suspect the right to bail, the ascendancy of armed robbery in the country lately, does not permit him to grant Mr Imam bail.
Presenting the motion for bail before trial to the court, Counsel for the respondents, Timothy Gyansi, said his client has been in custody for over three years without his case being brought to trial. He said Mr Imam, who was arrested on November 13, 2002 with some other persons, was not identified in an identification parade organised by the Police.
He said the Police did not have any evidence against his client and yet have kept him in custody all these years.
Mr Gyansi stated that judging from the backlog of cases before the court, it would take a considerable amount of time for his client's case gets its turn to be dealt with by the court.
Mr Gyansi argued that his client had relatives who were ready to support him with surety, if the court would grant him bail. "My lord, the accused has a permanent abode, which means, he will not jump bail."
But his plea did not move the court, which stuck to its decision.
