Kasap Ltd comply with court order

Kasap Limited, a construction company based at Abelenkpe, has complied with a court order to file a statement of defence for the court to set aside its earlier ruling pertaining to the severance award for ex-workers of the company.They also paid ¢10m to the court as cost awarded against them.
This was after a motion for stay of execution and an out of court settlement was presented by counsel of the defendants to the court at its last hearing.
Counsel for the Defendant, Bright Akwetey, admitted that there were outstanding issues to be settled with respect to the severance award of workers. He stated clearly the defendant's intention to pay the severance of the ex-workers.
Counsel for the Plaintiffs, Kofi Adde, highlighted on the issue at stake, the lives of 231 workers who have not been paid their salaries and benefits for the past four years.
He argued that they informed the Defendant some months ago about their desire to execute the court"s previous judgement but did not receive any reply from them.
According to Mr Adde, the Defendant?s action is a ploy to delay them in executing the court ruling. "They knew they could settle, why come to the court to seek the same thing," he queried.
In the substantial case before court, the plaintiffs, workers of Kasap Limited, were praying the court to compel the company to pay them their salaries, severance and other benefits due them.
Speaking to The Saturday Statesman after the case, Ransford Addo, a former employee, said several MOU's signed with management of the company to solve the impasse have all failed.
He said workers laid-off were facing a lot of financial hardship. "Some of us cannot pay our children's school fees as a result of this predicament," he added.
The Defendant, Joshua Akrong, who is also the Acting Manager of Kasap Limited, said they decided to seek a motion for the court to set aside its earlier ruling because they heard the Plaintiffs were planning on applying for 5A forms which will not auger well for the company. 5A forms, means the auctioning of particular assets belonging to the company.
He said the company accepts the fact that it owes its workers and is therefore working to solve the problem.
